
The president of Argentina, Alberto Fernandez, has initiated on Wednesday a parliamentary procedure to dismiss the Supreme Court, both its president and several of its judges, for the «poor performance of their duties» and «partiality».
«I summoned Germán Martínez and Carolina Gaillard, presidents respectively of the Frente de Todos Bloc and of the Impeachment Commission to deliver to them the request for impeachment of members of the Supreme Court of Justice of the Nation (CSJN) that we promoted with governors», explained Fernández.
Likewise, the Argentine president -who delivered the 30-page document at the Casa Rosada- said that he asked Martínez and Gaillard «to initiate its prompt legislative treatment», as stated in a posting on his profile on the social network Twitter.
The day before, Fernández, together with several governors, signed the impeachment request against the president of the CSJN, Horacio Rosatti, «for having repeatedly incurred in conducts that constitute the cause of bad performance of his functions provided for in article 53 of the Constitution».
Congresswoman Gaillard assured that the process requested by the President to the members of the Court will be carried out «with great seriousness and transparency», while she specified that «there are no precedents of an impeachment trial to all the members» of the court, as reported by the news agency Télam.
The President justified this unusual step by appealing to his own duty — «upon assuming my mandate I swore to observe and enforce the Constitution as far as it depends on me»–, for which he trusts to «prevent the continued manipulation of the Council of the Magistrature with unusual jurisprudential interpretations that allow the Judiciary to interfere in the decisions of the National Congress».
Fernandez and her number two, Vice President Cristina Fernandez, have spared no criticism in recent months against the judicial leadership, which they consider to be at the service of the political interests of opposition leaders such as Mauricio Macri. Both have framed the recent conviction of the vice-president for corruption as part of this alleged persecution.
