Brazil’s Supreme Court suspends a pardon granted by Bolsonaro to a former congressman

Brazil’s Federal Supreme Court has suspended the pardon granted by former president Jair Bolsonaro to former congressman Daniel Silveira, in prison since February of this year for failing to comply with the measures imposed by the Court.

Silveira had been arrested in 2021 for threatening Supreme Court judges and attacking judicial institutions, and finally sentenced to eight years in prison for threats and incitement to violence against magistrates.

However, Bolsonaro signed a decree pardoning the former deputy of the ultra-conservative Brazilian Labor Party (PTB) barely a day after the sentence was ratified.

The former president even elected Silveira to up to five committees of the Brazilian House of Representatives, including the Constitution and Justice Committee (CCJ).

In 2022 he was impeached and precautionary measures such as house arrest were decreed, but he was arrested in February 2023 after he damaged the electronic anklet during his house arrest, reiterated attacks against institutions and questioned the electoral process during the elections that gave the victory to the current president, Luiz Inácio Lula da Silva.

Now, the judges of Brazil’s Federal Supreme Court have argued for a week about withdrawing his pardon, finally agreeing to do so almost unanimously, with six votes in favor against two — the two judges placed by Bolsonaro during his term in office — as detailed by news portal UOL.
