
Twitter has asked a California federal court to dismiss a lawsuit filed by more than 100 former employees of the company due to «mass layoffs» that took place with the arrival of new CEO Elon Musk.
The social networking company’s lawyers have argued that the workers’ situation is not so similar and therefore does not meet the requirements to be considered as a class action, as reported by the ‘New York Post’.
In addition, Twitter’s lawyers have argued that the allegations presented are «vague and imprecise» and that the plaintiffs are not even trying to define a class or range of employees, but rather refer to «other similarly situated Twitter workers,» one of the platform’s lawyers told the court.
As stated by the aforementioned media outlet, the group of employees who have filed the lawsuit includes both workers who have already been laid off and others whose situation will not be effective until the beginning of 2023. Therefore, they are asking for the case to be dismissed or transferred to a court in the state of Delaware.
«We are ready to fight them one by one, on behalf of potentially thousands of employees if that becomes necessary. Elon Musk is not above the law,» the lawyer representing the employees, Shannon Liss-Riordan, shared in a message quoted on Twitter.
The lawsuits by former employees come after Twitter laid off nearly half of its workforce in November following Elon Musk’s acquisition of the company. The entrepreneur then formalized hundreds more layoffs by offering an ultimatum of doing «extremely hard» work or leaving the company.
As reported by CNN, the former employees scored an early victory this December when a judge ruled in their favor, ordering the company to inform all laid-off employees of the ongoing lawsuit. That is, to ensure that workers are better informed before signing a severance agreement that includes a waiver of potential legal claims.
